Employment Document Must Be Signed By Authorized Personel

One thing I have learned from employment disputes: companies often focus on whether they have a valid reason to discipline or terminate an employee.

Far fewer check whether every step of the process was carried out by the right person with the right authority.

In this Supreme Court case, a multinational company obtained approval for termination at first instance (the Industrial Relations Court). Yet the decision was later reversed. One of the issues examined by the Court was that the warning letters had been signed by a foreign director.

The lesson is simple.

Before discussing strategy, evidence, or business justification, make sure your employment documents are being issued by the people who are legally authorized to do so.

In employment law, process is not a formality. It can determine the outcome.
